## How Prolepsia reasons

## TL;DR
The saved forecast is **14.4% Yes** and **85.6% No** that a legally binding decree declaring an *état d’urgence* under Law No. 55-385 enters into force by December 31, 2026. The present unrest has raised the risk far above its normal short-run level, but the government has chosen localized curfews and standard security powers instead of the qualifying regime. The decisive fact is whether ministers issue the specific 1955-law decree, not whether France adopts other emergency-sounding measures.

## Context
The market has a narrow legal test. It resolves Yes only if an *état d’urgence* under the April 3, 1955 law enters into effect somewhere in the French Republic during the window. A public-health emergency, a state of siege, Article 16 powers, Vigipirate, natural-disaster declarations, and ordinary prefectoral curfews do not meet that test.

As of October 20, France was dealing with an unusually serious outbreak of urban disorder following the October 17 protests. The immediate question is whether this episode becomes sustained and unmanageable enough that the executive abandons its targeted approach. The remaining routes to Yes are a separate shock, especially in an overseas territory or from terrorism.

## Evidence
The historical backbone is a low base rate. The 1955 law is an exceptional instrument, used in a limited set of crises rather than as a routine response to disorder. The available chronology identifies use during Algeria and in metropolitan France in the 1950s–1960s; New Caledonia in 1985; Wallis-and-Futuna in 1986; French Polynesia in 1987; metropolitan France during the 2005 riots; the nationwide terrorism emergency beginning in 2015; and New Caledonia in 2024 ([Conseil d’État chronology](https://conseil-etat.fr/Media/actualites/documents/2021/09-septembre/ea21_etat-d-urgence.pdf)).

The closest modern cases point in both directions. The 2005 riots resulted in a declaration on November 8–9, after roughly 12 days of unrest; reporting describes more than 1,500 vehicles burned in a night and riots across 274 municipalities ([Le Monde](https://www.lemonde.fr/les-decodeurs/article/2023/06/29/qu-est-ce-qui-avait-declenche-les-emeutes-de-2005-et-comment-avaient-elles-pris-fin_6179835_4355770.html?utm_source=openai)). The 2015–17 emergency followed coordinated terrorist attacks in Paris and Saint-Denis (QPC360). In May 2024, the government declared under the same law in New Caledonia after extreme violence ([Council of Ministers, May 15, 2024](https://www.info.gouv.fr/conseil-des-ministres/compte-rendu-du-conseil-des-ministres-du-15-05-2024)).

The most useful negative comparator is 2023. France experienced severe urban violence with 2,508 damaged or burned buildings, 105 town halls, 243 schools, and 12,031 burned vehicles, but the government did not invoke Law No. 55-385 ([Public Sénat](https://www.publicsenat.fr/actualites/politique/violences-du-17-octobre-pourquoi-letat-durgence-est-ecarte-par-le-gouvernement)). That comparison shows why dramatic damage totals alone do not decide this market. The relevant threshold is whether ministers conclude that the situation is persistently beyond the reach of ordinary powers.

Current conditions are much more severe than the normal baseline. By October 20, reporting cited at least 2,400 arrests in connection with arson, looting, attacks on public buildings, and multi-city disorder ([AP News](https://apnews.com/article/13189fcb1481614dc65c2125deb8333d)). The government said at least 3,000 businesses had been damaged or looted and reported a criminal-response rate near 80% ([Prime Minister’s situation update](https://www.info.gouv.fr/actualite/prise-de-parole-du-premier-ministre)). These are preliminary counts from the immediate episode. They establish the seriousness of the shock, but do not establish that disorder will persist through year-end.

The executive has explicitly considered the relevant instrument. On October 19, Prime Minister Sébastien Lecornu said all tools remained available and that an *état d’urgence* could be used if necessary ([Prime Minister’s situation update](https://www.info.gouv.fr/actualite/prise-de-parole-du-premier-ministre)). That matters more than calls by political opponents, because the executive can make the initial declaration. The legal path is also fast: the law permits an initial declaration by a decree deliberated in the Council of Ministers, while continuation beyond 12 days requires legislation ([Law No. 55-385](https://www.legifrance.gouv.fr/loda/id/JORFTEXT000000695350/)). The market needs only the initial decree to enter into force.

The same evidence contains the central case for No. Lecornu characterized emergency rule as a heavy political measure and said partial, territorialized curfews were better suited to conditions at the time ([Prime Minister’s situation update](https://www.info.gouv.fr/actualite/prise-de-parole-du-premier-ministre)). Authorities instead used localized curfews, security deployments, investigations, prosecutions, assembly restrictions, and commercial-support measures. The first targeted-curfew night was calm in Paris, with future curfews to be chosen locally where needed ([AP News](https://apnews.com/article/13189fcb1481614dc65c2125deb8333d)).

This is the strongest current signal because it is observed policy, not rhetoric. Ministers assessed an acute crisis, discussed the exact legal option, and still chose narrower instruments. The data does not prove that this choice will hold. It does show that the declaration threshold had not yet been reached in the government’s judgment.

A declaration need not cover mainland France. The statute can apply to all or part of France, including eligible overseas territories ([Law No. 55-385](https://www.legifrance.gouv.fr/loda/id/JORFTEXT000000695350/2026-03-25)). New Caledonia demonstrates that a territorially limited declaration is a live modern precedent. That broadens the set of ways the market can resolve Yes, even if current metropolitan unrest eases.

## What's non-obvious
The obvious reading is that thousands of arrests and widespread damage should mechanically imply emergency rule. The 2023 comparator says otherwise. French governments can confront serious, geographically broad violence through conventional policing and targeted restrictions without declaring under the 1955 law. The question is about a legal and political choice, not a damage threshold.

The second non-obvious point is that Parliament is not the main near-term barrier. The initial decree comes through the Council of Ministers, and the extension requirement begins only after 12 days. This makes the Yes outcome responsive to a sudden deterioration. But it also means the government’s refusal to use the tool immediately carries more information: it was able to act and selected another response.

## Uncertainties
The central unknown is the trajectory of the unrest. Further planned mobilizations create opportunities for recurrence. Renewed disorder across several cities, fatalities, attacks on critical infrastructure, or clear failure of localized curfews and reinforced deployment would make a qualifying decree more plausible. The available evidence does not establish whether those conditions will occur.

There are three material gaps. First, preliminary arrest and damage counts are not final measures of severity or persistence. Second, the government’s public posture can change quickly after an acute event, and there is no basis to assume today’s policy choice is permanent. Third, the available record supplies no confirmed near-threshold overseas crisis or specific imminent terrorist trigger, although either could independently produce a decree.

The saved forecast keeps those tail risks meaningful while preserving the main conclusion. **14.4% Yes** reflects an elevated emergency-decree risk in an active crisis; **85.6% No** reflects the statute’s rarity, the demanding political threshold, the 2023 precedent, and the government’s early success with narrower measures.

## The question

Imported from Polymarket.
This yes/no question comes from a single Polymarket market.

### How it resolves

This market will resolve to "Yes" if a legally binding decree declaring a state of emergency (état d'urgence) in France enters into effect at any point between this market's creation and the specified date, 11:59 PM ET. Otherwise, this market will resolve to "No".

To count toward resolution, the corresponding decree must explicitly constitute a "state of emergency" (état d'urgence) as defined by Law No. 55-385 of April 3, 1955 (Loi n° 55-385 du 3 avril 1955 relative à l'état d'urgence).

Only declarations explicitly constituting a state of emergency under Law No. 55-385 will count.

A declaration covering any part of the territory of the French Republic, including overseas departments, regions, and collectivities, will qualify.

A declaration of a public health state of emergency (état d'urgence sanitaire) under the Public Health Code, a state of siege (état de siège) under Article 36 of the French Constitution, the use of exceptional powers under Article 16 of the French Constitution, the "Urgence attentat" level of the Vigipirate plan, a natural disaster declaration (état de catastrophe naturelle), or prefectoral orders issued outside of Law No. 55-385 will not count.

The primary resolution source for this market will be the Journal Officiel de la République française (legifrance.gouv.fr); however, a consensus of credible reporting may also be used.
